LMIA(劳动市场影响评估/雇主担保), 是雇主出面去劳工部(ESDC)申请的外籍劳工许可

LMIA 什么用？

1. 外籍劳工可以凭借LMIA来加拿大工作/拿工签

2. PR申请者，可以凭借LMIA给申请加600分(EE http://helpteam.ca/latestnews/shownews.php?lang=cn&id=42)

3. 公司可以凭借LMIA雇佣有特殊技能/不可缺少的外籍人才

LMIA 分几类？

与之前的LMO不同，LMIA分为以下4类

1) The Stream for Higher-Skilled Occupations — High-Wage Workers

2) The Stream for Higher-Skilled Occupations — Low-Wage Workers

3) The Stream for Lower-Skilled Occupations — High-Wage Workers

4) The Stream for Lower-Skilled Occupations — Low-Wage Workers

谁可以申请LMIA?

LMIA只能由雇主/emplyer 或者 律师/ICCRC等在雇主授权下申请，外籍劳工不能自己申请

什么是High-Wage, 什么是Low-Wage?

低于各省平均工资的为 Low-Wage, 高于各省平均工资的为High-Wage

各省平均工资 ($/hour)

谁不能申请LMIA?

Accommodation, Food Services and Retail Trade sectors(饭店/零售业等)在失业率高于6%的地区不能申请LMIA

同时，一下职业不能申请LMIA：

• 6641 Food Counter Attendants, Kitchen Helpers and Related Occupations

• 6661 Light Duty Cleaners

• 6611 Cashiers

• 6622 Grocery Clerks and Store Shelf Stockers

• 7611 Construction Trades Helpers and Labourers

• 8612 Landscaping and Grounds Maintenance Labourers

• 6672 Other Attendants in Accommodation and Travel

• 6663 Janitors, Caretakers and Building Superintendents

• 6662 Specialized Cleaners

• 6651 Security Guards and Related Occupations

雇主需要提供哪些材料？

1. Job Offer

2. 公司营业执照/•Business registration or legal incorporation documents (if first LMIA application);

3. ◦T4 Summary of Remuneration Paid (most current year ending)
   ◦PD7A Statement of Account for current source deductions (for 12-month period preceding LMIA application)
   ◦Schedules 100 and 125 - T2 Corporation Income Tax Return (for corporations only - 2 most recent returns filed)
   ◦T2125 Statement of Business or Professional Activities (for sole proprietorships/partnerships only – 2 most recent returns filed) ;

公司可以有多少外籍员工？

申请新的LMIA，公司最多只能有10%外籍员工(Low-Wage的情况下); 从2016年7月1号开始，已有外籍员工(需要LMIA)的比例不能超过20%
