Successful Case: Another Canadian Humanitarian Immigration Successfully Approved in June! It took only 11 months!
In late October 2020, Canada announced an immigration plan that aims to admit more than 400,000 new immigrants each year from 2021-2023, the highest number of new immigrants in Canadian history. In Canadian history, only in 1913 did Canada receive more than 400,000 new immigrants, more than 5% of the population at that time.
With so many favourable immigration policies, if you are not currently eligible for Canada's general immigration program categories such as skilled, investment, or family reunification, and have received a removal order after a failed refugee claim, what other ways are there to successfully immigrate to Canada without legal status?
In previous cases, HelpTeam has introduced you to the Canadian Humanitarian and Compassionate Consideration (H&C), a category of application that allows immigrants to apply even if they do not meet any of the requirements.
Under section 25 of the Immigration and Refugee Protection Act of Canada, the Immigration Service may, based on an application by a foreigner who is inadmissible or does not meet the conditions of the Immigration Act, grants the foreigner permanent resident status or exempt the foreigner from the obligations or conditions under the Act, based on sufficient humane and compassionate considerations and having regard to the protection of the interests of the child. This provision of the Act gives immigration officers the authority to approve an immigration application in cases where the applicant does not meet the immigration requirements, taking into account the humane and compassionate factors involved in the applicant's case, and is intended to give immigration officers some policy flexibility concerning the practical application of the Act in circumstances not foreseen by the Act.
HelpTeam will consider a combination of factors such as the applicant's residence in Canada, the frequency of contact with Canadian, his or her own health condition, the ability to protect the best interests of the child, factors in the applicant's home country (such as economic reasons or climatic conditions when health reasons are involved), and family circumstances, i.e., to prepare a well-documented humanitarian and compassionate immigration application. Because many Canadian immigration applications and immigration appeals are filed for humanitarian reasons, it is necessary to seek help from an experienced immigration lawyer to provide adequate explanations and strong written requests.
