Under section 25 of the Immigration and Refugee Protection Act of Canada, the Immigration Service may, based on an application by a foreigner who is inadmissible or does not meet the conditions of the Immigration Act, grants the foreigner permanent resident status or exempt the foreigner from the obligations or conditions under the Act, based on sufficient humane and compassionate considerations and having regard to the protection of the interests of the child. This provision of the Act gives immigration officers the authority to approve an immigration application in cases where the applicant does not meet the immigration requirements, taking into account the humane and compassionate factors involved in the applicant's case, and is intended to give immigration officers some policy flexibility concerning the practical application of the Act in circumstances not foreseen by the Act.
