Nearly 6 hours of continuous court battles, the client and his 3 friends gave different answers about various times, places, people, and events, and even said things that are completely contradictory. Our client was eventually released in court in spite of numerous adverse evidence and conditions
Just came out of the courtroom, this case needs a special attention today.
The basic situation of the client (please see the arrest warrant of May 23rd and the release warrant of May 25th):
In 2011, the client came to Canada on a student visa and applied for refugee status 2 months later.
April 2014 : Refugee application denied
August 6, 2014 : Client failed to report to 6900 CBSA, deportation proceedings were suspended and client started illegal overstay
August 22, 2014 : Canada Border Services Agency and Immigration Canada jointly issue a wanted notice against the guest
May 23, 2018 early morning : Client was driving with a friend when he encountered a police inspection, he was discovered and arrested on spot
May 23, 2018 morning : The guest was transferred to a CBSA detention center and CBSA initiated mandatory deportation proceedings
May 23, 2018 evening : The guest contacted us through a friend in prison, and after we understood the situation, we decided to accept the case
May 24, 2018 morning : Our office negotiated with the prison authorities and the CBSA for release without success
May 25, 2018, 9:00 am : We went to court
May 25, 2018 at 2:28 pm : After almost 6 hours of battling and war of words, we were able to get our client released!
Today's court session was particularly difficult for a number of reasons, the main ones being the following:
1. the guest and his 3 friends, when testifying and stating the contents, there were discrepancies and even inconsistencies in the answers to key information such as time, place, people and events
2. The client was rather impatient and had too many emotional fluctuations, and was warned by the judge several times, and had an incident of arguing with the judge
3. The client's passport has been hold by CBSA, and the mandatory repatriation process has been started
4. the client has been wanted for years and has not cooperated with the government's legal procedures for a long time
